This is Michael Popak, Legal AF.
We got a brand new pack that was created for Donald Trump
and we got Elon Musk, who basically lied several months ago
when he said he was not going to contribute
to either the Biden or the Trump campaign.
He's done exactly that.
And we'll find out even more on
July 15th when new reporting comes out about this shadowy PAC created in Texas by self-proclaimed
constitutional law expert Chris Goeber out of Austin, Texas. All we know about the PAC so far,
it was created in effectively in May and now it has obtained a substantial investment,
a substantial donation from Elon Musk of Tesla fame and Starlink fame. Again, back in March,
after meeting with Donald Trump to try to calm investor issues and issues around people that use X. Musk said point blank, I am not
contributing to either campaign. So the way he's going to get around that is that he's made his
multimillion dollar donation, we can presume, to a PAC, America PAC formed by Chris Goeber,
who is allowed to work in conjunction with the Trump campaign based on a recent
ruling of the United States Supreme Court to do one thing in particular, voter outreach,
voter registration, and to try to promote the use, get this, of mail-in ballots, absentee
ballots, and to have a plan on election day. Now, you'll recall that all
through 2016 through 2020 and beyond, Donald Trump was the first one to come out and say,
you can't trust mail-in balloting, you can't trust absentee balloting, it's all rife with fraud and
all of that. But the Republicans figured out they were getting their lunch handed to them, their heads handed to them by the Democrats in the absentee mail-in voting.
So they're trying to chip away at that advantage and they're using a pack, a super pack like
America pack, again, popped out of nowhere. Apparently, according to the New York Times
and other reporting, has already spent about $16 million.
It's only been around a couple of days.
And now it's just got replenished its accounts,
and therefore Donald Trump,
with millions more likely from Elon Musk.
It also means that for every dollar the PAC can pay
to promote Donald Trump and Donald Trump's candidacy,
it's one less dollar the Republican National
Committee and the campaign has to spend.
So even though there's not supposed to be coordination between the campaign and the
PAC, the super PAC, except when it comes to voter registration and field operations to
get people to vote and get out the vote, everything else is supposed to be independent.
So when you see an ad for Save America, or I'm sorry, the America PAC running for
Donald Trump, that's not supposed to be coordinated with the Trump campaign. They're not supposed to
coordinate how much to spend, where to spend, the type of ad, digital media versus social media,
versus good old fashioned radio, versus good old fashioned newsprint. They're not supposed to
coordinate any of that. But of course, America PAC is using
consultants that have worked directly for the campaign and other campaigns. Chris Goeber,
it's an interesting cat, don't know much about him, except he appears regularly in Fox News
as some sort of self-proclaimed constitutional scholar. Here's a clip.
Chris Goeber, a constitutional law attorney who has worked for the Republican National
Committee and the Department of Justice.
So last Monday, you probably know this, that Trump's attorney, Todd Blanch, told the court,
there's nothing wrong with trying to influence an election.
It's called democracy.
Is that true?
Is that constitutional?
Yeah, absolutely.
Is it a crime?
Yeah.
So, you know, in this instance, you have to understand from the get-go, this entire prosecution
rests on this unconstitutional effort to federalize a New York state law that by turning a low-level
misdemeanor, if they're even one of those, into a felony based on a flawed interpretation of federal
election law.
And a lot of people look at this and look at the payments, say if it did occur, that
it had an impact on Donald Trump's chances to be reelected.
But the federal election commissions test and federal laws test on determining whether
that payment would in fact be impermissible or not is not based on whether it could
actually have an impact on an election.
Instead, the Federal Election Commission looks at it
and says, is there any other reason other than the election
in which somebody may want to make that payment?
And in this case, that's undeniably yes.
We've heard instances of Donald Trump
making other settlement payments in the past.
And so the facts really and the evidence is there
that there were other reasons other than
to impact the election for him to make this payment
if that were the case.
So I know as well as the next guy

Trump and his campaign, set up this America Pack knowing, I'm sure, that there
was going to be, in terms of coordination, a major donation from Elon Musk. And now Musk is trying to put his
big fat billionaire hand on the scales to influence the outcome of the election.
American people don't generally like when billionaires try to buy an election.
That usually doesn't go over very well. And because of the mass number of voters,
even outweighs a billionaire dollars, they usually rebel.
We'll have to see now what we're gonna do
with the number one billionaire on the Bloomberg scale
at 260, weighing in at $263 billion of net assets,
Elon Musk puts his big fat thumb in wallet
and bets it on Donald Trump.
I would love to give you more information
about the America pack.
From what I can see right now,
I don't know anything about its board of directors
and neither does anybody else.
I don't know how Alina Haba is involved with it.
I don't know, all I know is Chris Gober used to work
for Ted Cruz and has some sort of media
and strategy company.
The bulk of the money they're spending right now until they get the Musk dollars, the Musk
bucks, has been spent in field operations, opening up field operations, phone banks,
and aimed at voter registration, and aimed at digital media, which is relatively easy
to get up and running, and all of that.
That's what they're focused on.
Now, if that focus change, once their coffers are replenished with new musk bucks, we'll have to
follow. We'll have to follow the money. This is the Supreme Court and Citizens United who allowed
dark money to enter into the campaigns at unlimited amounts because
they declared it first amendment right of a company or corporation or a pack to donate.
And now we see what's happened to our elections.
You need $205,000,000,000,000 to run for office.
And with it, you're beholden to all the people, of course, that have given you money.
Now, Elon Musk is not an altruist.
He's a businessman, he's transactional.
And so he's getting something in return.
He thinks it's better for him,
just like the oil and gas industry
thinks it's better for them
to have Donald Trump in the White House.
I wonder why that is.
Especially when Joe Biden has been a big promoter
of electric cars.
I mean, Biden has been clear.
He's not a Musk fan, he's an electric car fan,
and he's complimented Musk for building pretty good electric cars. I mean, Biden has been clear. He's not a Musk fan. He's an electric car fan, and he's complimented Musk for building pretty good electric cars. I got my own opinions about
Tesla. This isn't a stock picking show, so I'll leave it at that. But nobody likes the way he
tried to manipulate Ukraine during the Ukraine war with Starlink. No one likes the fact that
there are major military assets in the hands of civilians,
in this case, Elon Musk who built his own satellite network which unfortunately
outmatches anything that the military has been able to put up for the United States.
And now he's decided, let me interfere with elections. Let me donate as much money as I can
to a shadowy organization that nobody knows anything about
who's going to reveal its first donor list
in about three or four days on the 15th.
And I'll be able to report more on that then.
But what we've got right now is the about face
by Donald Trump, which we reported on here
on the Midas Touch Network, I don't know,
a week or two ago, where suddenly he started running ads
and running videos, including on the America Pak website,
saying, early voting's important,
mail-in voting's important, absentee voting's important.
I thought it was stop the steal, Donald.
I thought you thought that every election,
including the one that your head of cybersecurity
for election integrity said
was the most secure election in history, the 2020
election. I thought that's because of all of the outcome dispositive fraud in absentee ballot
voting, absentee voting, and mail-in voting, and early voting. I thought that was the problem,
but no, no, no, because he knows he didn't win on that. And so he's going to have to try to grab
some of that early voting advantage
that Democrats usually have because Democrats are not afraid of voting early, absentee, or mail-in.
They know their vote is going to count either way. A vote is a vote is a vote. The quality of the
vote isn't changed by how it's delivered to the ballot box. It's ludicrous, especially for somebody
like Donald Trump who every year whenever he got around to voting, and that wasn't that often, he voted by, wait for it, absentee or mail-in
voting.
Right.
And so I think the purpose of this hot take is to talk about Elon Musk, who put himself
on the sidelines and said, don't worry, don't worry, I'm not picking sides here.
I'm not donating to the campaign.
Listen to that choice of words, not donating to the campaign of Trump or Biden. Right, he donated to a pack that works
closely in coordination with the campaign. And every dollar they spend is one less dollar the
campaign has to spend. So if he puts 30, 40, 50, a hundred million dollars, right, which he can do
hundred million dollars, right? Which he can do with one stroke of a pen. That's his walking around money. That's his chump change. That's his folding money, as my grandfather used to say.
He can help change the outcome of the election. The question for the audience is,
are we going to let billionaires determine who our next president is, especially when
they're placing their money on a convicted
felon, on somebody who's been in a judged rapist.
Is that what we're doing?
So we're going to continue to follow the America PAC and when it makes its final donor list
public, which they have to do, and I'm sure we're not just going to see Elon Musk there. I mean, Donald Trump is busy courting industries to support him. Oil and gas,
energy, telling them they should donate billions of dollars to him because the first thing he's
going to do is deregulate. There's a reason that at the end of July, when he finally gets
around to announcing who his new vice president pick is going to be, they're going to be doing
that in front of the oil and gas industry. What does that tell you about the candidacy
of Donald Trump and where Elon Musk is placing his bets? We'll continue to follow it on the
Midas Touch Network and on Legal AF, Wednesdays and Saturdays at 8 p.m. Eastern Time. And then
on hot takes like this one that I do, Michael Popok, I don't know,
