I'm Ben Myceles from the Midas Touch Network.
Let's talk about what's been going on in the New York attorney general civil fraud trial
against Donald Trump, the Trump organization and others.
We are in week three and it's been some bombshell testimony.
I know that lots of other media networks are not covering what's going down,
but they should be because this stuff is massive, massive, massive. You got Patrick Bernie
testifying earlier in the day, the assistant vice president and financial operations officer
at the Trump organization. He helped prepare a lot of these fraudulent statement of financial conditions from 2017 to the present
that the judge presiding over the case, judge and Gora and has already ruled against Donald
Trump and found that summary judgment should be granted in favor of New York attorney general
Leticia James.
There was this Perry Mason moment.
I've been talking about these bombshell moments after bombshell moments
that have taken place at this trial.
Shout out and had to to Adam Klassfeld, reporter over at the messenger who's there, subscribe
to the messenger.
By the way, they're doing great work.
And he was there.
He and some other reporters captured it, but here's how he described it.
You have the attorney general lawyer questioning Patrick Bernie, grilling Patrick Bernie.
And then there was this question at the end. Mr. Bernie did Alan Weiselberg ever tell you
that Donald Trump wanted his net worth on his statement of financial conditions to go
up. Yes or no. And then Patrick Bernie said, yes, then there was objection, objection
Donald Trump's lawyers led by Christopher Kice objected to the admissibility of the
testimony and they said, judge, this is the epitome of hearsay. This is the heart of hearsay,
motion to strike, remove it. And judge and goreons had looked all entertained some
briefing on the issue. If that's hearsay, let me just peel that back for a second. I strongly
believe that is not hearsay and that will be admissible. hearsay is an out of court statement used to prove the truth of the matter asserted.
And here because it's a statement made by a party opponent, a party in this case,
Alan Weisselberg, it's per se, not an out of court statement.
It's not under the definition of hearsay.
So I don't believe it's hearsay at all.
Alan Weisselberg could be cross examined on those statements because he is a defendant
in this case.
You know, a lot of the questioning of Bernie then focused on this Trump executive on the
Trump brand premium, right?
You'll recall that Donald Trump has been saying, oh, we've never added a brand premium.
There's no such thing as a brand. I should have
added, we're like Coca-Cola. I should have added the Trump brand premium. Well, there's a ton of
evidence that Donald Trump fraudulently added a Trump brand premium into the statement of financial
conditions and then claimed he didn't add it. And that's how he would inflate the valuation by 15
and sometimes as much as 30% adding presidential brand premiums,
Trump brand premiums into the financial condition.
So that's a major part of the cross-exam of Patrick Bernie.
And also one of the things that we see Trump do over and over again,
like he did with the square footage of the triplex where he lives.
He claimed 10,096 square foot triplex was 30,000 square feet,
just kind of randomly multiplies it by three and then uses that square foot
to justify the fraudulent square footage to justify a higher valuation.
He does that with like everything.
And so for example, like his property in Aberdeen in Scotland, for example, when there is
a limitation of the amount of units that can be built on an Aberdeen, Trump will say it's
two or three times that amount.
When it's actually the amount of kind of units
that can be built on a property are written in an agreement.
So it's like obvious fraud that's taking place.
Here, let's pull this up.
This was shown, this was a major part of judge and goreons order.
And this was a major focus as documents were shown to Patrick Bernie, the Trump brand premium.
And this is what Judge and Goran previously found in the Summary Judgment Order.
That the undisputed evidence indicates that for the years 2013 to 2020, the statement
of financial conditions relied on values that included a 15 or 30% premium based on the Trump
brand for the following seven golf clubs. Trump National Golf Course, Jupiter, TNGC LA,
TNGC Coltsnack, TNGC Philadelphia, TNGC DC, TNGC Charlotte, and TNGC Hudson Valley. However,
the statement of financial conditions for those years and indeed all the
years before this court also contained expressed language stating that quote, the good will attach
to the Trump name has significant value that has not been reflected in the preparation of this
financial statement. Accordingly, the statement of financial conditions, quote, double dip, both purporting not to include a brand premium while simultaneously
including one of 15% or 30%.
And so when Donald Trump says he didn't add a brand premium, I mean, he, he did.
I mean, it's, it's undisputed that he did.
And the statement of financial condition says he did not.
So again, that's kind of furthering the life.

sheets were showed to Patrick Bernie.
For example, you would see the spreadsheets and where it says under the value of fixed
assets, you would see all these notations.
Like 15% premium is added for a fully operational branded facility.
And so you had these notations.
Here is another one, as I mentioned with Aberdeen, for example.
Here's how it was described in Judge and Gauron's order.
The Trump Organization owns a golf course located in Aberdeen, Scotland.
The value assigned to Aberdeen was comprised of two parts, a value for the golf course,
and a value for the development of the non-golf course property, the latter
of which is the focus here, developing any of the non-golf course property required the
local Scottish authorities approve any proposed plans.
From 2011 to 2014, Donald Trump's statement of financial conditions reported that he
had, quote, received outline planning permission from Scottish authorities in December 2008 for a residential village consisting of 950 holiday homes and 500 single family residences and 36 golf villas. had outlined planning permission to build a total of 1,486 homes, notwithstanding the 2014
to 2018 statement of financial condition valuations of Aberdeen, assumed the Trump organization
had received approval to build 2,500 homes despite never having received such approval.
And so folks, there's just undisputed fraud like that.
And that's why I just really care about the evidence
and the facts and not the yelling and the screaming
and just charges and operative,
like this is just focus on the facts.
And so when Patrick Bernie took the stand,
the same way when Donald Trump's gonna take the stand,
the same way when Weiselberg,
Donald Trump's former chief financial officer and Jeff McConney, Donald Trump's former
controller who testified that Weiselberg told him to commit fraud.
When these people take the stand, you just ask them the questions.
You said, isn't it true that the Scottish authorities limited the total amount of units
that could be built to 1,486 homes?
Yes or no?
Yes.
And isn't it also true that your statement
of financial conditions claim 2,500 homes?
And didn't you do that to increase the valuation?
And isn't that number false and fraudulent?
It's just that simple.
You take the emotion out of it,
I could take the passion out of it,
and just surgically go through the evidence, surgically go through
the data.
And so that's what the New York Attorney General's lawyers were doing.
Showing Bernie, read the documents, here are the houses, here are the units, here is
who receive the emails.
One of the things Patrick Bernie was shown, for example, is an email that he was on showing
that, quote, I put three copies for the kids and their folders on your chair.
You and Jeff McConney have copies on your desk.
I'll call you tomorrow.
He was asked, well, who are the kids that you're referring to?
And they were referring to Ivanka, Eric, and Don Jr. just think about that.
They're referred to the Trump adult kids as kids in emails. But
that shows that all of the Trump kids who are going to be testifying had access to these documents.
And so why is the New York Attorney General bringing Bernie now before the Trump kids to build the
foundation, right? So when the Trump kids testify, which will be happening soon, they're going to be when they say,
well, we never saw this. Well, you're going to have Patrick Bernie saying that's who it was
referring to as well. Then there was a recess that was taken. There was more evidence about
Patrick Bernie being involved in various meetings about planning of the statement of financial conditions.
And then ultimately it concluded with the testimony that I gave you at the beginning of this video.
I don't want to bury the lead here, but it's the question, did Alan Weisselburge ever tell you
that Trump wanted the network to go up? And the answer was yes. So there was other witnesses as well.
Nothing yet as bombshell as Patrick Bernie's
Testimony, but we will keep you updated as we learn more and
but but just follow the evidence follow the data
