Did Donald Trump just violate his gag order in the New York criminal case during a campaign stop in California by going after one of the prosecutors in the Manhattan DA's office just a day after the highest court in New York rejected his appeal? That's what it looks like. So you've got again this intersection of Donald Trump, the candidate, and Donald Trump, the criminal,
Starting point is 00:01:26 and subject to gag orders colliding. And since Donald Trump isn't all there, he's half in the bag, he's unwell, and his mind doesn't track, you get images like this. Donald Trump going after Matt Colangelo, who used to work in the Department of Justice before he became a special prosecutor in the Manhattan DA's office, it's exactly what Judge Murchon said he could not do in the modified gag order in New York. A gag order that's been upheld by two levels of appellate courts in New York in the last
Starting point is 00:01:59 couple of months. What Donald Trump said during this California press conference, this rambling screed of a press conference, but one clip in particular is where he mentions a prosecutor who used to work in the Department of Justice who's gone after him. And that's because Matt Colangelo, much like Taylor Swift, is renting real estate for free in Donald Trump's head. Donald Trump has a thing for Matt Colangelo. It drives him absolutely up the wall that Matt Colangelo is on the prosecution team. There are still events left in the case and that is why the pellet courts have kept the gag order in place. You can't go after witnesses.
Starting point is 00:02:41 You can't go unless the certain ones that have already testified. You can't go after witnesses, you can't go, unless the certain ones that have already testified, you can't go after jurors, you can't go after the staff of the judge, you can't go after family members of the judge and of the prosecutors, and you can't go after the staff prosecutors at all. It just undermines our justice system and the integrity of it. I mean, there's no other way to put it. If Donald Trump, with intent to materially interfere with the administration of justice, went after Michelangelo at that press conference, he just violated the gag order. And it's something that the Manhattan DA's office and prosecutors everywhere should watch and should listen to.
Starting point is 00:03:24 I mean, he's subject to gag orders in multiple places. He's got a version of a gag order in Georgia. He's got a gag order that's still in place in the District of Columbia, and he's got a gag order against him in New York. Now he keeps complaining, Donald Trump does, that oh, my core constitutional presidential campaign speech is being inhibited.
Starting point is 00:03:42 This is Donald Trump inhibited? He gets up with no notes, does an hour and a half press conference, which is just a campaign speech where he goes after all of his political enemies, including here, Matt Colangelo. I don't see any limiter on his speech. If this is Donald Trump disciplined and abiding by gag orders, I would hate to see what he looks like and how he talks if he didn't have a gag order against him. The gag order is not interfering with his ability to communicate his message, whatever it may be,
Starting point is 00:04:14 to his voters, whoever they may be. I mean, Donald Trump right now is reduced to attacking and accusing the Democrats because some mentally unwell person in a bush, you know, a couple of holes above him in the golf course, you know, was planning to do some grievous harm against him. That's not, that's not the Democrats fault. I mean, at the moment where Donald Trump could unite the country and not make this political,
Starting point is 00:04:42 he and his minions immediately go to the political. Oh, the Democrats are trying to do whatever they're going to do to Donald Trump. It's Joe Biden who was in the Bush. It's Joe Biden's policies or Kamala Harris's policies that put that guy in the Bush with an AK-47. I mean, at some point, you just have to say that this was an unwell person who wanted to do some harm to Donald Trump. That's it. So there's no limits on Donald Trump's speech.
Starting point is 00:05:11 There's no limits on JD Vance's speech. Whatever message he's planning to communicate, and I don't know what it is, but whatever it is, he's able to communicate it. But what he's not able to do is violate that gag order. And even though he didn't use Matt Colangelo's name by name, he didn't say, well, Matt Colangelo is after me in New York, you know, that would be, I guess, a direct violation. I think Judge Murchon needs to have a hearing about this issue. And then more to the point, while I would love to have Donald Trump end
Starting point is 00:05:42 up at an evidentiary hearing where he's going to have to account for himself for violating the gag order, the judge could also just make his own findings about Donald Trump's conduct before, during, and after the trial and conviction, all the way up to the moment of sentencing when the judge sentences Donald Trump. I've said this before at prior hot takes. Donald Trump is on the horns of a dilemma of his own making. As a campaigner, he wants to say outrageous things to titillate and motivate his base
Starting point is 00:06:17 and get them to vote for him and throw red meat at them at news conferences and speak to this small group of 40% of Americans that will let Donald Trump say and do anything because they like his policies or they think it's funny. And so, you know, he's got that. But he's also the subject of the criminal justice system. He is a defendant, a convicted defendant in New York, an indicted criminal defendant in DC and Georgia. Starting point is 00:08:40 this episode. And there's sentencing on the November the 26th, a couple days before Thanksgiving, in the New York case on 34 convictions of Donald Trump. It's not one conviction. It's 34 felony convictions, 12-0 by a jury. One that Judge Murchon pointed out in his own recent orders. He said, the hardest thing for a trial judge to do is to enter sentence against someone
Starting point is 00:09:10 who a unanimous jury found committed 34 felony counts of crimes. That's the hardest part. Not that he's the president of the United States, former president of the United States, campaigning for the presidency of the United States. In his mind, he's still the president of the United States, campaigning for the presidency of the United States, in his mind he's still the president of the United States, whatever. He's just a run-of-the-mill garden variety, two-bit convicted felon at this point. And everything goes, and all of these feeds go into sentencing. The recommendation by the Manhattan DA's office with a full list of all of the bad conduct
Starting point is 00:09:43 and misbehavior by Donald Trump, not just the crimes he committed, all the conduct, his failure, Donald Trump's refusal to be contrite, his failure to take responsibility, his failure to cooperate with the prosecution and forcing the prosecutors to put on that case for two and a half years and waste taxpayer dollars. All of that, his ten times violation of the gag order in the past, new violations of the gag order, new attacks on the judge and the judge's daughter, new failed attempts to waste the appellate court's time, the trial judge's time, trying to have him disqualified or recused because his daughter happens to work for a Democratic candidates out of an office in Chicago. All of this goes in.
Starting point is 00:10:26 Sure, the judge will read the sentencing recommendation report by the defense. He has to, it's called due process and he'll do it. And the one by the probation or parole board in New York. But the end, the judge has to make his own determination through his own research and his own sort of judicial approach to sentencing of how long Donald Trump is going to be sentenced to jail. And Donald Trump's not helping himself continuing to bang the drum to violate the gag order in advance of his sentencing. If I were him, I would be on my
Starting point is 00:11:00 best behavior between now and November 26th since I'm the subject of a criminal prosecution. You could say all you want is they drag you off to jail, but that'll be your last press conference for a while if that happens. Donald Trump can't do that. He's not disciplined. He's incoherent. He's unwell. His logic doesn't track.
Starting point is 00:11:22 He can't put a straight sentence together. Everything's a corkscrew. He tries to cover it up by saying, well, I've had people say that if you just wait long enough, I'll tie it all together. You could never tie together and connect the dots that you lay out in these press conferences, even if we gave you an infinite amount of time because you can't keep track of them all. I mean, I'll do another hot take about Donald Trump recently trying to be a crypto bro and trying to argue about cryptocurrency
Starting point is 00:11:51 and demonstrating he doesn't know what cryptocurrency is. He doesn't know how it works. He said his 18 or 17 year old son, Barron, knows more than he does. He then started to talk about power, power needs of artificial intelligence, which crypto is, I mean, not really artificial intelligence in the way we commonly understand it. He then went off to talk about how his granddaughter speaks Chinese. I mean, I mean, if Joe Biden talked like this and did talk like this, you know, they were trying to run him out on a rail for running for reelection. And yet this guy, you know, pushing 80 crazy crap my opponent says every day, every day with no limiter on it. Gag Order is not working, but that's okay because either the judge holds in New York the gag order hearing or he just as I said bakes it into the sentencing decision,
Starting point is 00:12:47 not recommendation. The judges don't make recommendations. They make, they impose sentence and that's what we're going to keep an eye on. As Donald Trump on the campaign trail, as campaigner continues to put Donald Trump, the criminal and indicted person and somebody subject to gag orders in harm's way.
